Public School Special Education Teacher Attacked by Student - Is There a Claim?

I received a call yesterday from a public school teacher who was brutally attacked by a special education student in the Bay Area. Her hope was to file a personal injury claim against the school district for her substantial injuries, which included a concussion and eye injuries.

Unfortunately, under California Law, the worker's compensation laws are the exclusive avenue for recovery where a public school teacher is injured on duty by a student. The courts will generally not allow a personal injury claim over and above a worker's compensation claim.
